I live in New Jersey, and I am well aware of Nj's talkking and driving laws, unless your hands free and avoid my cell phone while drivin at all costs.
That being said, last week, I was on my speakerphone with my cell phone in my door panel. I was trying to help a friend with somethin as I was headin towards her, so I was lookin to get as much info as possible from her. An officer in front of me, pulled over and behind me and pulled me over. He wrote me a ticket for bein on my phone, which I explained I was on speaker phone, and the phone wasnt in my hand. He said it didnt matter, and hung up. Now while I was on the phone at a stop sign, I was switchin songs on my iPod, and hung onto it when I started driving again, so maybe the officer mistook that for my cell phone, but im not sure.
Anyway, before asking for some help here, I did a little research, and I know thet MOD for this section is a NJ trooper, so Im hoping to get some feed back.
http://www.njleg.state.nj.us/2006/Bills/AL07/198_.HTM is a piece of Senate legislature that states, and I quote... "...except when the telephone is hands-free...
or the electronic communication device is being used hands-free.". For anyone opening the link to verify, its in section 1a, and is the second underlined portion of the document.
All this being said, I need to know if I have the grounds to get the ticket thrown out on the fact that I was hands free and technically not breaking any rules.
