So I got a ticket in my Own Development Today, But my car cant go that Speed?

Alright so coming home from Bloomsburg today i make the hour and half trip no flaws....However I pull into my development and get pulled over in my driveway for doing 39 in a 25...

Thing is the turn i made into my developmetn and where he said he clocked me aka stop watched me at was literally like 25yds max and my Civic Hatch in 1st gear cannot go 40mph? It would be windiing out hardcore prolly tached out idk even know....

So i pleaded my case how ive lived here for 20 years i know where all of you sit in my development im not an idiot my car cant go that fast in 1st gear turning into my development its not possible...

Then he got on me about emissions, My car is registered where i live in the poconos and i was coming home to my parents house for the weekend, saying i needed emissions and i was like NO carbon county does not need emissions he was like its not exempt on your registration card? So i was like idk i know i dont need it, then he got on me about my insurance card saying it was expired then i was like no read write here vaild until April 2010...

Then he was like oh your that kid who got parts stolen off that white car, i wrote the report for that ...GEE THANKS

So im definitly fighting this

3 points on my licesense and 150 dollar fine is some bull for something i did not do...

I asked to see the print out of my speed and he refused to show me?

he stop watched me he said, and i was like can i see whatever proof you have, and he was like what do you think im lying to you? ANd i was like well i know my car cannont go that fast in first gear....

Then said will they work a court date around me being a student and he said ya, and we can work out the points when you show up? I want this all dropped, i cant see how this is possible, I never speed in my own development i know its a highly cop traffic area and my car cannot go that fast?

I just hope it all works out...Finals next week this is all i needed

#1 if you turned into your developemt you probally didn't downshift into first. Plus most cars have a first gear lockout and you have to really fight it. If you do get it into gear your engine is going to scream and make you sounds like you driving like an ass.

So lets assume that you know how to drive and hit the turn in second gear as I assume you would. It isn't hard to get over 25mph. You were probally speeding, weather as fast as he said who knows, there is reaction time involved with timed tests so they are only so accurate, but they do hold up as it is SOP for police. They don't do it just for kicks, they are trained.

Best of luck with your court date though.

i was at a red light before making the turn into my development i was in 1st gear its a 95 1.5l civic hatc cx, honestly not kdiding when i say its impossible to go that fast in frist gear....

stop watches are inaccurate up to like +/- 10 mph. blinking, breathing, twitching, and a bunch of other homeostasis activities all come into play. plus, he needs two exact distance markers to get an accurate distance to divide the time it took for you to cross that distance (time clocked on the stopwatch) for the equation to find your average velocity. (cant be speed because you need directions based on the specific topography, which i doubt he found out) so was there an exact distance he measured out? was there anything blocking his line of vision crossing the 2 distances? how far was the distance? what was your time clocked on the stop watch? seems like a lot to do and then to pull you over so quickly, especially since you are familiar with the area and were seconds away from your destination.

That all makes sense to me, in my rents development there are white lines on the road between each entrance of teh branchinge developements so there was definitly something there for him to stop watch my by....however there is no way i was going that fast...

I know that development like that back of my hand, everywhere the cops sit ive lived there for 20 years..I NEVER SPEED Through there

well, good luck with this. atleast you wherent in ohio, or else your car would have been impounded.

Seems like things can go either way. court might just see another car enthusiast trying to get out of breaking the law, or an actual misjudgment by a cop. hope it works into your favor

car enthusiast? he was in a bone stock civic hatch, which, doesnt have a first gear lockout. fight it and bring up all the things that 92sileighty said when you get there. also, before you get there, do the math yourself and figure all those things out so if the cop is a retard and makes you actually have a hearing, you have proof against him. he'd be smart to drop it after you bring all that stuff up to him beforehand.

Well the thing is i know the PA-3111A statue to plea to that,

However doing some simple calculations on paper....If the 2 lines were 120ft apart and he was off by 6/10ths of a second thats a +7mph increase in my speed....

How can that stand up?

Im about to go out and measure those lines tonight and get the math down...

Do it! Cuz with a low speed like that, it could make or break your case. In the case of like 70 in a 55, 5mph doesn't make a huge amount of difference. In this case, it does. It's worth goin outside and measuring and what not.

Well, when you do go to court. I hope your argument is "I'm not an idiot I know where you guys sit", because that will get you no where. I don't know what area you live in, but where I live, walking into a traffic violation court room, for a speeding ticket, and yelling out a bunch of numbers will just get you thrown out. Your either going to get lucky, and the officer won't show up, OR the point will be dropped, and your fine will increase. They don't care about the points on your license, they care about bringing money in to the township. So they will have no problem trading off your points for an extra 75 bucks.

measure and take pictures. bring in specs on the car as well.

also find a source that talks about human reaction time. if you're going to hit them up with "6/10's of a second" you may as well tell them what the average reaction time is for someone when using a stop watch... i'm sure there is something out there somewhere...

Im not going to use i know were you sit, i was just saying that...and throwing numbers out there is not something im going to do and would not get you thrown out in any court room thats rediculous

I know PA-3111A Pleae gets you a 106+ dollar fine and 0 points, but i feel i should not have to pay this at all...(my mom and several friends have used this plea)

I am going to do that, i just got home from college, was pulled over in my driveway and just was pondering how this could be, so went on here....Im sure the court date wont be for a month or so....

He said he was def. going to be there, because he was like when you set up a court date we can work out the points when you get there

Im with this turd. Stating facts will not get you thrown out of any courtroom. You sir, are probably 15. You obviously have no idea how court rooms work. You are given a chance to take the stand, and state your case. If you have facts to state, you can state them. It wont get you thrown out of any courtroom, probably not even turkish ones.
