TST need advice about an auto insurance situation..

So I came home one night from work and found my Civic totaled on the street on 46th and Walnut (University City), there was a note on there and when I called the person told me that a Malibu ran a red light and hit my car along with a Magnum, on the note were tag numbers of both cars. This was last wednesday (8/4).

I can only afford liability insurance so my insurance can only track down their tag number for me and I would have to settle it with them myself, which they did. When I contacted the insurance rep of the Malibu, they told me that their policy holder said the Magnum was the car that hit my car, not the Malibu so they are not accepting liability yet until the police report comes in and they'll see what really happened according to the report (another week or so). Anyways, the Malibu's insurance, not accepting liability yet, still sent out an adjuster today and they determined my car is totaled (duh!) and they gave me a price of $2400 because it has a salvage title at one point, I didn't know this because my dad bought me the car back in high school. The car itself ran perfectly and was in great condition in terms of paint and body.

I don't know what to do... I've been out of a car since last Wed and noone will accept liability yet so I can get a rental. I went to Enterprise to try and get a rental in hopes of being reimbursed but they said sometimes insurance companies won't reimburse if they didn't agree to a rental in the first place.



So my question is, do you think this guy's insurance is yanking my chain with the whole not accepting liability since they did send an adjuster out and they DID give me a price for my Civic and said their Total Loss division will call me tomorrow.

Any thoughts?

They could just be covering their ass, in the event that they DO have to pay up, and you already have a figure.

Did you get in touch w/ the owner of the Magnum's insurance company? What are they saying?

Also both insurance company's will send someone out to see the cars that they insure to check the damage they have and take pics of that damage too and you have right to see those pics. (but if no one takes responsibility it will be up to you to go after them in civil court.) also did you file a police report yet?

Thanks for the replies guys,

I haven't gotten in touch with the Magnum's owner or insurance yet, all I have is their tag number and my insurance rep hasn't gotten back to me yet. The Malibu's insurance rep said she hasn't gotten in touch with the Magnum's owner or rep either, that's one of the problems. The Malibu's insurance is tracking them down now last time I spoke to them.

What if I don't accept the price that they gave me? do you think they will offer more if I threaten to take whichever car is responsible to court since they have to get a lawyer and everything? I can't accept the price they gave me... I can't get a good and reliable car such as my Civic for that price and in that condition.

I can answer the price thing. Take this time to do your research. Find comparable cares on cars.com and autotrader.com. Use this as a barganing chip. Being that the car has a salvaged title it is a bit tougher but you have a little leeway. Never get over bearing or excited when talking to the insurance company but be firm. Explain to them that this car meant more to you than just a book value and your replacement cost is much much higher. I squeezed almost 3800 out of a daewoo with a book value of 2K. Good luck man.
