A good Samaritan who helped push three people out of the path of a pickup truck before being struck and injured has gotten a strange reward for his good deed: A jaywalking ticket.

Family members said 58-year-old bus driver Jim Moffett and another man were helping two elderly women cross a busy Denver street in a snowstorm when he was hit Friday night.

Moffett suffered bleeding in the brain, broken bones, a dislocated shoulder and a possible ruptured spleen. He was in serious but stable condition Wednesday.

The Colorado State Patrol issued the citation. Trooper Ryan Sullivan said that despite Moffett's intentions, jaywalking contributed to the accident.

Moffett had been driving his bus when the two women got off. In the interest of safety, he got out and, together with another passenger, helped the ladies cross.

Moffett's stepson, Ken McDonald, said the driver of the pickup plowed into his stepfather, but not before Moffett pushed the two women out of the way.

When he awoke in intensive care, he learned of the ticket. "His reaction was dazed and confused. I was a little angry," said McDonald.

The other man also was cited for jaywalking, while the pickup driver was cited with careless driving that led to injury. Sullivan said the two elderly women haven't been cited but the investigation is ongoing.
COP is a DB.. sorry to the cops on here.

discuss.

hmm, depends... if he was helping the women walk across the street outside of a crosswalk (my understanding of jaywalking) then yes... he did contribute to the accident. While i normally keep an eye out regardless, i'm more aware of pedestrians on a cross walk

What, and they're looking to cite the old women, too? Ugh.

simple... if they weren't jaywalking, they would probably not have been hit, or risked being hit

like you dont cross a street without using a crosswalk?

everyone is an idiot in this. the people should have looked before crossing, the driver for not being aware, and the cop for dbaggery.

It was during a snow storm, so im assuming visability was low. If he didn't help, those two ladies would probably be dead

Right, well they should've been walking in the cross-walk but I think getting hit by a truck was punishment enough.

haha seriously. And who says "oh, the old ladies almost got hit by a truck? Serves 'em right!"?

Who gets ticketed for jaywalking anyway?

i'd rather two old bags getting hit than a productive and youthful member of society

regardless... they did contribute to the accident and should be cited as such.

If snow was a factor then spotting a crosswalk is out of the question. But I agree with both sides here. Look both ways before you cross (DON'T RUN ACROSS THE ****ING BOULEVARD!!!). Look for peds at all times.

It may have contributed to the accident, but are we not responsible for our vehicle at all times, i.e someone jumps out in front of me and i hit them its ultimately the drivier of the vehicles fault....

Least i am under the impression one must be in controll of their vehicle at all times....

i don't understand how it would be your fault if you're just driving along ladi****ingda and someone jumps out in front of the car. sure, you may feel guilty... but its not your fault.

its a matter of being responsible for yourself

I just read that. If I was that cop I'd feel like too much or a dick to ticket him after what he just did. Somebody didn't get his donut that day.

I understand that but i was always under the impression one must have complete control of their car at all times, hence being able to stop and not hit someone even if they did jump out at you....

which would be impossible. if you're following the speed limit and someone jumps out right in front of you and you can't avoid coming into contact with that person i really can't see how you'd be blamed for it.

Eclipse GSX 61: did you really read it? He helped them cross the middle of the street... nice guy, yes... old people walk slow, take them to the crosswalk and cross there. better chance of being spotted and less chance of being hit by a truck. He helped in a situation he created, good for him for not just getting out of there.

Oh man i know that its damn near impossible but i just thought that was the way it was.....I mean even every case ive heard of something like that the driver was given careless/wreckless some type of citation like that for hitting someone.....

not sure 100%, but i'd fight a case like that big time. I'd get experts and everything on that ****, pictures, measurements from the scene, etc.

you just need to prove that you were operating the vehicle lawfully and were not able to avert the accident by taking another action... whether that be stopping in time or swerving into traffic or what.

But yeah, i guess you're right... pedestrians are usually given the benefit
