careless driving
There were 4 motorcycles, we turned into the parking lot and came up behind a cop car parked in the lane of traffic. My 1 friend went around on the ride side of the cop car and the rest of us went to his left. He crossed the ends of an empty handicap lane (mind you all the parking spots next to the cop car were empty). He did about 5mph since its a 85 gs 600. Old slow tank. Beside these couple spots the rest of the lot was packed since it was 10am with 6 flags traffic. So we make it around to the side of the lot of wawa out of traffic since we had bikes. The officer is a state trooper that pulls up behind us as we were getting off of our bikes. He walks up to my buddy that went around on the right side and goes off. He goes on about how if he open his door he could of hit him and so forth. He gets all his information and his PERMIT since he doesnt have his license yet but the other 3 riders have thier license's and he never ask who the license driver was. He just says oh your on your permit you dont have enough experience to do that. He goes back to his car where we assume was a training officer since state troopers dont ride paired up. Makes him write the careless driving ticket. The main officer that got out came back with the ticket while the other officer never got out of the car. Gave him his ticket and left. The officer never turned on his lights to record this stop either. Well thats the case that happen and my question is now, is it still illegal to write tickets on private property AKA the wawa parking lot? Should my buddy get a lawyer for this case or plead it down himself? One more piece of info to add. We had to take the jug handle to make a left to get into the wawa. We came around and stopped behind a car. The car had its 4 ways on and had no one in it. The car was in the middle of the 2 lanes there so we went around it. The cop had to see this car or pass it to get into the wawa parking lot.

THere is nothing illegal about writing summons on private property for careless driving. I do believe the trooper will have hard time proving his case in court if all your buddy did was go around his car in the parking lot.

Yes thats all that happen. He was about 3 feet from the squad car. I was right behind him until he turned right to go around him and I watched the whole event. Thanks for the reply and is there anything if he should do to help out his case, maybe have us 3 go with him?
