Its clearly a common issue, I dont know if honda has issued a recall yet, but your best move is to go to the dealer and tell them, if nothing, call honda corporate. Its under warranty, they should fix it, if not get a lawyer, its not like you have no evidence to stand on, if there isnt a recall, honda simply isnt taking care of their customers.

almost every k-series transmission has problems with the 3rd gear synchro. most of the time where it pops out of gear is when the shifter is not fully engaged into 3rd gear.

how to fix the problem...

shift slower, and try to feel it engage (should feel like it clicks twice)
if it wont go into gear, put it into neutral and double-clutch

it definitely is, im a big honda fan and it grew on me since the first time i saw it. Plus i was looking for a sedan so that was perfect but knowing honda's past transmission records I didn't want to deal with it already out from factory. The recall has the techs replace a few parts inside the transmission so i would of had to put alot of trust in my dealer.

well much like everything there are good eggs and the bad, however when they need to do a recall i would be weary. better transmission fluid could be a bandaid also, much like ppl saying synchromesh FM fixed their grinds.

I read in SCC a few months back that people were talking about a class action lawsuit for just this problem. Apparently Honda hasn't been owning up to this trans issue.
