Read and discuss!

This is so messed up, and ruins it for those who can't have children.

That is total bull****!

*edit- it is messed up that they would make him pay in the first place. Glad the decision was overturned though.

already dropped?

The 3-2 decision overturns lower court rulings under which Joel L. McKiernan had been paying up to $1,500 a month to support twin boys born in August 1994 to Ivonne V. Ferguson, his former girlfriend and co-worker.

Well IDK, this is a strange one.

This wasn't just a walk in the clinic, jack off in a cup, whoever gets it has my kid in another state kind of thing. The two parties were in a relationship, and when it started to fall apart the woman asked if the man would donate his sperm under X conditions. This is strange to me, they were having sex and then the girl gets twins after the dude rounds one off into a cup? Wierd, lol.

Either way, it doesn't feel like a "true" sperm donation, as normally the father is completely anonymous and an already married couple does the whole get the weird dude's sperm thing.

But I agree, total horse****. They agreed that the donation would be done with no child support etc, and then she changed her mind. Bitch is SOL if you ask me.

He was paying $1500 a month for 7 years, and I doubt he gets that back.

i understand. just saying, the decision has already been made that he doesnt have to pay. and they might give it back to him since he was paying under false pretenses

Do you honestly think that lady who is raising two kids will be able to shell out $126,000 or $1,500 or anything even remotely close to that every month to pay him back? No chance in hell.

no, but restitution isnt usually paid in a lump sum...im just playing devil's advocate here. i understand the chances of him getting his money back are slim to none, however, since a previous courts rulings were overturned, so should the effects of that ruling.

Hopefully he will get something back, even if its just 1/3 of what he paid her.

Yeah, but how does one court say that this guy needs to pay child support for doing someone a favor.

because usually when the father "leaves" the mother, child support is owed. in this case, there was an agreement made by two parties that, in the end, proved to be binding. its hard to know what the actual ruling of the first court was, nor do we know what was presented as evidence or testimony. its a shame this guy didnt get a chance to plead his case sooner.
