Considering my DSM won't see more than 3k miles this year there is no reason it wouldn't pass. Besides, my DSM should easily pass a sniffer test and safety inspection. If I drove it more my guess is 90% would pass it. The dump tube and missing EGR would probably make a couple anal retententive mechanics freak out.

IIRC, Shep's car was a daily driver until it was running low 10's/high 9's.
