court 2moro any help?

as some of you already know I was pulled over awhile back for doing 90-in 65 ( which I was not doing) any how I have a Trial tomorrow and I did not hire a lawyer because I think they are a waste of money and time. So I was wondering what should I bring with me and what should I ask for them to prove.?

P.S it was in Hopewell Township. So I was wondering if a Hopewell police officer can pull me over on RT 95 or is that out of jurisdiction

ok... go to court talk to the public prosecutor they will usually at least drop it 10 mph and yuo should be ok... i got gigged doing 80 in a 40 and was dropped to 10 over in mount laurel, just took me 9 hours in court to do....

yea i already went to court befor and they dropped it to 75 in a 65 with a 400 fine i was not going to take that either!. i told them i want a trial beacue i def do not desive that ticket!

it duno its gonna be kinda hard for you to prove that you werent going 90 in a 65 especially without a lawyer..you can try for careless driving which is 2 points and $188 fine..25 over is initally a 4 point ticket right? in that case careless would still hit you with 2 points which is better then 4 and it would cost a lot less then $440. You could always shoot for an unsafe driving which is 0 points and a pretty large fine...over $300 i think..but that will definitely be hard to get since 25 over is a pretty good speed ( regardless of if you were doing it or not they are still gonna go by the ticket he gave you ). As for the cop being rude to you i dont think that will hold up and help in your defense at all...alot of cops are gonna **** with kids and bust their balls about stupid stuff...especially in a sporty car...and even more especially in hopewell...im guessing they dont have a printout of your speed? if they dont i guess you can ask for one to prove you were going 90 but im not sure if they can get it now..im not sure how that whole system works..anyway if you cant get 0 points definitely try for the careless cause your not gonna pay as much in fines..worst case scenario your insurance goes up a little ( depending on your company ) and you get 2 points..you can always pay $60 to go to the AAA defensive driving class which drops 2 points and up to 5% off your insurance...anyway hope this helps a little.. a lawyer would have definitely been in your benefit.. but would probably have charged you at least $250 but probably closer to 4 or $500..either way good luck..

Do you have any evidence that you were not going that speed?
If it comes down to you word vs. the cop's word, you probably will loose the case.
Worse yet, they most likely will not offer 75 in a 65 again, but stick you with the original charge and fine of 90 mph.

Without a lawyer, you might want to try for another plea before the trial starts.
Sucks, but all they really want is your money. Would hate to see them get your money and still give the points with a 25 over fine too.
Suck it up for a few hours and be courteous and kiss some prosecutor ass.

Your word means **** to them.

Attack the equipment. Ask about the method used to calculate/get your speed.

If it was a stop-watch dealy, mention human error and that you weren't going that fast and it would be easy for an officer to miscalculate the speed, or hit the stop watch too late/too soon, etc.

If it was some kind of radar equipment ask for its maintenance records, when was it last serviced, calibrated etc. Go online now and research how often those things need to be calibrated to work correctly.

Take pictures of the area you were caught speeding in and before that. Ask the cop where he was parked/driving at the time he clocked you, and from which points you were at when he clocked you.

Time of day is important too, heavy traffic? other cars passing you, you passing someone, etc. Attack the situation, not the officer. The officer very well may have clocked you at the speed he gave you a ticket for. His equipment may have been faulty, human error may have come into play, or he caught a reading from a European Swallow.

Do you research on the equipment officers use to get your speed, or to calculate it and the laws governing their upkeep.

From someone who has been there - you are screwed.

Despite what you think about lawyers you cannot expect to go up against the DA or ADA and win.

I speak from experience when I went to court for the same thing. I had 2 witnesses stating the police officer did not tag me doing the speed he said I was at and I had a Ford mechanic come in as expert testimony to testify that given the circumstances my vehicle could not have been going the speed I was radared at.

It was all thrown out due to legal verbage and etc etc.

At least have the public defender there and pray the cop doesnt show up. Otherwise expect to pay. Sorry man. Even the excellent advice given by the others (scapegoat especially) it will not matter. It will all be discounted by this law or that amendment.

I almost got a contempt of court violation because I was SEETHING at how ridiculous it was. Especially since I showed up on time and they made me wait two hours to get the cop to come in because the person who scheduled my trial did not notify them properly. I said- well this was real Fair and SPEEDY. Thats when I got warned for contempt of court. Its all BS dude. Good luck. You'll need it.

This is the best advice in this thread thus far, except get a lawyer. Also, if you are absolutely convinced that you were not traveling at that speed, contact the police department ahead of time and ask that the officer bring in car video of the incident. However, I am assuming (and this is with no offense intended because maybe it is just the internet typing thing) that by the grammar in your posts and the "Driving While Arab" comment, that English may not be your first language. If you can't speak English clearly, you are going to be at an even bigger disadvantage. I have been in the Paterson and Newark Public Courtrooms many times and judges are quick to mete out the most severe penalties when someone can not get their point across clearly. Again, I say this with no offense intended, but maybe to convince you that a lawyer speaking on your behalf is not a bad idea. Anyway, good luck and let us know how you make out.
