Imports of Lancaster test drive accident law suit

A few years ago the salesman driving the evo with a customer and his father flipped the car killing the father. This is the latest update from the law suit, very very unfortunate.

So because you pull out in front of a car doing, (probably) twice the speed limit (driving recklessly).... its your fault? And how its not on the salesman at all? I mean did he even get a ticket?

can you not read?

"Hershey pleaded guilty in January 2012 to one count of homicide by vehicle, one count of driving under the influence of alcohol or a controlled substance, two counts of recklessly endangering another person, and one count of driving a vehicle at an unsafe speed. He was sentenced in March 2012 to 3 ˝ to 14 years in state prison on charges of homicide by vehicle, DUI and reckless endangerment, according to a story by The Intelligencer Journal/Lancaster New Era. The crash that killed Jensen was Hershey’s fourth DUI conviction, according to court records."

I didnt read he was cited. But I'm more referring to the fact he was driving recklessly and impaired into the side of a Truck and the Truck pays the brunt of the damage?

That's a bit off as well as the dealership only having to pay $20k out of their pocket. They are the ones who hired a salesman with 3 prior DUIs on his record. Most dealerships won't hire you (can't because of insurance) with anything near that, typically even one isn't ok.

if he was serious about buying the car, why was the salesman driving? I mean maybe not let the kid drive, but pops should have atleast been driving it. If i ever go look at a car and the sales person tells me to hop in the passanger seat, i'd laugh.

Wow I actually test drove an Evo & STi at that dealership some years back. Very, very, very sad story, a great father just trying to buy his son the car he wanted. May he RIP.

Also confuses me as to why the insurance of the mulch truck has to pay? I guess the Evo had the right of way being it was traveling straight down the rd, when a heavy mulch truck turned in front of it while struggling to make it up to speed.

I was under the assumption that if you are DUI, you are automatically at fault regardless of the situation since you should not have been on the roads in the first place. smh

At fault in an accident report and at fault in a civil suit are two totally different things. In situationas like these, there becomes a 'search for deep pockets:' The dealership likely only had $1.5 million in liability insurance coverage which is why that is all they were on the hook for. If the lawyers were then able to deduce that the mulch company had liabiltiy limits of $3 million, you better believe they are gonig to do everything they can to establish some sort of fault and trigger a payout. Thus, more money coming from the mulch company does not necessarily mean that they were 'more at fault,' but that they carried higher limits of liability insurance. I am surprised the dealership was only required to pay $20,000 out of pocket... they must have head a good defense lawyer.

Blows my mind that guy was able to get a sales job at a dealership with his record... I had a few (20+) speeding tickets with one license suspension but no accidents/DUI's etc. and couldn't get a job as a detailer at a dealership when I was a lad.
