If her injuries are legit, she clearly has a chance. All she needs is an okay lawyer, medical experts OR just follow up reports from her doctors, and time. Let your insurance company fight it as long as they can, they have some of the best lawyers out there anyway. They will probably be able to settle for WELL below $75k, hopefully below $15k for your sake. If it doesn't get settled for under your coverage, you better be ready to pony up for that lawyer.

Hopefully people realize that $15/30,000 coverage is complete crap. Cheaper doesn't=good.

i could never sue someone over stuff like this, its a god damn accident, its not like u did it on purpose, dont people feel bad taking $75k off someone, its pretty much stealing imo. hopefully something very bad will happen to her before this court case, so she wont be able to show up.

I was wondering if you could clear something up. I read near the beginning of the thread that you said you had 15K medical covereage....are you sure you're not confusing that with your PIP covereage? In that scenerio, her claims would fall under your maximum liability coverage, not your medical allowance. Also, it is NEVER a good idea to make posts about any info involving a lawsuit. If she stumbles upon this, everything you posted here is admissable in court. If you do get a lawyer, I would alert him to this thread so he can successfully defend you if this is brought up during the discovery phase of the trial. If you are carrying that crap 15K/30K mini policy then I would upgrade to protect your financial future in case of another accident. 100k/300k is the minimum coverage any financially minded individual should have. Lawsuits in pain and suffering cases rarely settle more than that amount unless there was gross negligence on the driver's part. Also I could be mistaken, but I believe your car insurance will only represent you up to your policy limit. If you're being sued in excess of your policy limits, I think you have to personally hire and retain your own lawyer but check that out with your insurance company. Good luck. That sounds like total ass! But double check about your liability covereage though.....you may be worrying about something you don't need to worry about.
