wow what is happening to america?

got this from 240sxforums...this is a bunch of bull****. where do i register as a sex offender? cause i know ive slapped a lot of asses in my time.

NEW YORK (July 25) -- Two middle-school students in Oregon are facing possible time in a juvenile jail and could have to register as sex offenders for smacking girls on the rear end at school.

Cory Mashburn and Ryan Cornelison, both 13, were arrested in February after they were caught in the halls of Patton Middle School, in McMinnville, Ore., slapping girls on the rear end. Mashburn told ABC News in a phone interview that this was a common way of saying hello practiced by lots of kids at the school, akin to a secret handshake.

The boys spent five days in a juvenile detention facility and were charged with several counts of felony sex abuse for what they and their parents said was merely inappropriate but not criminal behavior.

The local district attorney has since backed off -- the felony charges have been dropped and the district attorney said probation would be an appropriate punishment. The Mashburns' lawyer said prosecutors offered Cory a plea bargain that would not require him to register as a sex offender, which the family plans to reject.

But the boys, if convicted at an Aug. 20 trial, still face the possibility of some jail time or registering for life as sex offenders.

The boys' families and lawyers said even sentencing them to probation would turn admittedly inappropriate but not uncommon juvenile rowdiness into a crime. If they are convicted of any of the misdemeanor charges against them, they would have to register as sex offenders.



"It's devastating," said Mark Lawrence, Cory Mashburn's lawyer. "To be a registered sex offender is to be designated as the most loathed in our society. These are young boys with bright futures, and the brightness of those futures would be over."

Cory Mashburn said he and Ryan Cornelison slapped each others' and other kids' bottoms every Friday. "Lots of kids at school do that," he said.

Cory and Ryan were brought to the principal's office Feb. 22, where they were questioned by school officials and a police officer. They were arrested that day and taken in handcuffs to a juvenile detention facility.

Court papers said the boys touched the buttocks of several girls, some of whom said this made them uncomfortable. The papers also said Cory touched a girl's breasts. But police reports filed with the court said other students, both boys and girls, slapped each other on the bottom.

"It's like a handshake we do," one girl said, according to the police report.

The boys were initially charged with five counts of felony sexual abuse. At a court hearing, two of the girls recanted, saying they never felt threatened or inappropriately touched by the boys. The judge released the boys but barred them from returning to school and required that they be under constant adult supervision.

District Attorney Bradley Berry has since dismissed the felony counts. The boys face 10 misdemeanor charges of harassment and sexual abuse. They face a maximum of up to one year in a juvenile jail on each count, though Berry said there was no way the boys would ever serve that much time.

"An appropriate sentence would be probation," he said. "These are minor misdemeanor charges that reflect repeated contact against multiple victims. We never intended for them to get a long time in detention."

"We're not seeking major penalties," he said. "We're seeking change in conduct."

'We Just Want This to Be Over' Tracie Mashburn, Cory's mother, said they will not accept plea and plan to fight the charges.

The arrests, critics said, reflect a trend toward criminalizing adolescent sexual behavior. Between 1998 and 2002, juvenile arrests for sex offenses other than rape or prostitution rose 9 percent -- the only kind of juvenile arrests that rose during that time, according to the Bureau of Justice Statistics.

"More and more, they are criminalizing normal adolescent or preadolescent behavior," said Chuck Aron, co-chairman of the National Association of Criminal Defense Lawyers juvenile justice committee.

Even probation, the Mashburns and their attorney said, would be too severe a punishment.

Julie McFarlane, a supervising attorney at the Juvenile Rights Project in Portland, Ore., said, "Probation for a sex offense is very difficult thing, and there's a pretty high failure rate." Failing to meet the terms of probation could mean the boys would be sent to jail.

Depending on the terms of probation, it's likely that the boys would not be allowed to have sexual contact with anyone or any contact with younger children, McFarlane said. For Cory Mashburn, that would mean he couldn't be left alone with his younger siblings.

"It's been awful," said Cory's mother. "We just want this to all be over. But it will never go away. We'll always remember it."

Berry, the district attorney, said the victims -- the girls who were touched -- were being overlooked. "What's been lost in this whole thing are the victims, who have been pressured enormously by these boys' friends," he said.

Cory, who said he now realizes what he did was inappropriate, spends his days playing video games and basketball. He said he's scared. "I could go to jail. I could be registered as a sex offender," he said. "I think it's all crazy."

I heard a story like this this morning. A guy driving his family cut off 2 guys in a SUV. They passed the family and the one guy mooned them. Well there was a 14 yr old kid in the car and now the guy who mooned them is being charged and will have to register as a sex offender.

absolutely disgusting. it bothers me to no end how they kept saying 'victims' in the article. there are no victims, there are no criminals, there are only two completely normal young kids being looked at in the same light as rapists and child molesters. F that, there are too many lawyers in this world just trying to make a quick buck. this is right up there with suing mcdonalds for not warning about hot coffee.. it's retarded. common everyday acts that somehow get turned into crimes by someone's sick and twisted mind.

what next, is it going to turn into a crime for elementary age kids to chase girls around at recess?? maybe it's sexual harassment somehow?

our legal system is sickening.

i cant believe the da is actually thinking of making them sex offenders and ruining their lives. cause you know, thats the best thing to do for our children today...MAKE THEM SEX OFFENDERS!! cause they wont be able to work at mcdonalds prob.

i was just talking to my wife about this last night. they are getting way too liberal with the child molesting thing. yes there should be very strict laws but this is borderline retarded.

on the news some guy slept with a 14 year old over the past 5 years (i think she is 19 now) but because she was 14 when they started having consensual sex and he was like 20's or 30's? he has to register as a sex offender and a child molester. so now he is finally getting out of jail and horsham township is trying to ban him from the community saying there is a daycare near his house. i mean wtf, yea he nailed some slutty 14 yr old that probably thought it would be cool to nail some older dude but saying he is going to go rampaging through a child day care and molest every kid is retarded. before dateline nbc im sure a lot of guys were getting there kicks with young girls and unfortunately young girls dont seem to think its wrong to do an older guy. anyways, my point is, there are people out there that kidnap, molest, and kill innocent kids. and they are grouped with the same guy that moons a passing car or some guy that found a little tramp to stamp here and there. they are going to water down what a sexual predator is if they keep this **** up. keeping the real sick and dangerous guys in jail and registered as sexual offenders should be top priority over grabbing everyone you can that does anything remotely wrong and yelling child predator at them

The whole 'mooning' situation has to fall under some form of freedom of speech thing....The dude was just expressing his feelings toward the other driver. I guess I better watch out when I salute my favorite drivers. It happens frequently.

wow all of this is pure nonsense. i cant believe how sensitive people are becoming. in the first article, more than 5 girls recanted statements saying they didnt feel violated in any way shape or form, and one GIRL said its something that EVERYONE does as a greeting or handshake type deal and the DA is still trying to get these kids into trouble. reading that is absolutely sickening. i couldnt even imagine what i would do if i was in those two young guys' shoes. unreal

The DA is getting what they want, national attention. Someone should sue them for ruining the lives of these kids by using them as pawns to further their own career and agenda to make the whole country a bunch of pussies.

this almost happened to a friend of mine in HS. he mooned another kid getting of the bus on the way home. the next morning in school there were 2 cops waiting for him. he got suspended and all kinds of legal issues all because the kids sister was at the bus stop too and now she was "scarred for life". even though his sister was 15 and ****ed half the neighborhood anyway.

wow.....thats all i can say....im speechless.....i remember this one day in life when i was like 14 i ran up to my friend and smacked her ass really hard and she got real pissed and pulled my hair and stuff but we were fine after that...we kid aroudn like that and she had a sense of humor and knew what a nerd i was (am) .i cant imagine her going home and tellin her parents and then me getting arrested for it! wtf man thats so wrong....yeah its childish and stupid and wrong but like....wtf man theyr kids!



itd be diff if it was some 45 yr old guy sneakin into girls locker rooms at middle schools and grabbin ass but like, come on this is stupid....the ppl filing for charges just want publicity and thats not fair to the kids whos lives will be ruined by registering them as sex offenders

The D.A. is probably too scared to step up and say they these kids should not be registered sex offenders. He/She is probably scared that people will get mad if he says that.

didnt read any replies.

i've done it to - but to girls i know, and i know dont mind

if they were walking around school smacking random girls asses, and they had a problem with it, **** THESE KIDS

they should be sex offenders...

if my daughter(please god dont let me have a daughter) was smacked on the ass at school and felt uncomfortable i'd want the kids removed from the school and punished to the fullest extent...
