Passing on the right, on a 3 lane highway?

Is this illegal? I got pulled over for it and I think it's BS. If it's ok to pull me over and ticket me for passing someone doing below the speed limit. then why don't they pull over the person disrupting the flow of traffic and not keeping to the right?

I wasn't speeding past them, and i did use my blinker.

I would just like to know the full extent of this "Passing on the right law"

you can not pass on the right. If the car was in the far left lane doing under the speed limt you should have goten behind him and waited for him to alow you to pass. I know, nobody does that.

Just to add to this question because I'm not clear on it... the law says it is illegal to pass on the right, but there is nothing regarding being in the left lane (and driving below the speed limit, or just staying in the left lane even when you're not passing)?

no there is but but you traval at at least 40mph on a road thats posted 55mph or more. You and i both know 40 mph is very slow on a highway. So if the other vehicle in question was doing at least 40 mph there in no volation of speed but there is a violation of failure to keep to the right.

can you define what passing means then, say you are at a stop light and you accelerate faster than the person on the left? is that passing? or for instance, the right lane is moving faster than a person in the left, is that passing?

All in all i think the "LAW" needs to start enforcing the "keep to the right" more and then there will be less aggressive driving to begin with.

I just think it's BS i get stopped for trying to do the polite thing, and not tailgate a slower driver. I did follow him for a minute, and he made no effort to move to the right. So i decided that instead of tailgating him and honking my horn, to just pass him at a legal speed.

Section 3304(a)
Overtaking vehicles on the right.
General rule - The drive of a vehicle may overtake and pass upon the right of another vehicle only under one of the following conditions:
i. When the vehicle overtaken is making or about to make a left turn, except that such movement shall not be made by driving off the berm or shoulder of the highway.
ii. Upon a roadway with unobstructed pavement of sufficient width for two or more line of vehicles moving lawfully in the direction being traveled by the overtaken vehicle. , except that such movement shall not be made by driving off the roadway.

3304(a)(ii) makes it seems as though passing on the right is acceptable on a highway.

New Jersey has something similar:
New Jersey Statute
39:4-85. Passing to left when overtaking; passing when in lines; signalling to pass; passing upon right
The driver of a vehicle overtaking another vehicle proceeding in the same direction shall pass at a safe distance to the left thereof and shall not again drive to the right side of the roadway until safely clear of the overtaken vehicle. If vehicles on the roadway are moving in two or more substantially continuous lines, the provisions of this paragraph and section 39:4-87 of this Title shall not be considered as prohibiting the vehicles in one line overtaking and passing the vehicles in another line either upon the right or left, nor shall those provisions be construed to prohibit drivers overtaking and passing upon the right another vehicle which is making or about to make a left turn.

I checked with my traffic guru and he told me that these are recent changes made to account for modern interstate highways that enter and exit from both sides of the road.
