Carfax buyback guarantee, am i eligable? Insurance company ?'s too.

Ok, so most of you know i crashed my gsx. Well today i recieved a 30 page packet of papers from my insurance company about my car. There are some things i dont understand , maybe you guys can help me with.

1. Ok, when i purchased my car Dec. 8, 2004 , I was presented with a Carfax report on the car. It said there was 0 accidents and 0 incidents with the car. So a clean carfax. Well today when i got my papers, there is a acdident listed by Vinguard on 3/19/98. Right front heavy damage. My carfax, i got said no accidents. Why is there a accident listed on here? Who can be sued here, carfax , or the place that sold me the car and supplied me with a fake/innaccurate carfax.


2. My insurance company gave me a total of $6,820. Everyone here knows you cant buy a 2gb 97 gsx for that much in the condition my car was in. They got the value of my car from the price of local cars in the area for sale. They supplied a list of local cars for sale, and they said the average price was $6,820. Well when i went through the 5 pages of local cars for sale, all of them were GS and RS models, except one , which was a 97 gsx. Of course the price is unlisted. So they based my price off of GS and RS models. Is this legal??

3. They deducted 64$ for having a cassete deck, and 96$ for the Infinity sound system, when both in fact are STOCK ITEMS! HOW CAN THEY DEDUCT MONEY FROM ME ON STOCK ITEMS??!?!?! They also deducted $321 for a manual trans. Why?

4. They are taking $561.24 in tax. When asked, what tax this is, they said tax to resell the car. Well thats not my problem, is it? NO, why and i paying for them to resell my totalled car??

5. They are deducting $500 for my deductable. But my car is totalled? why are they taking $500 off?

6. My mom works at a dealership, and they told her they cant take tax and deductable money. So why are they doing it?

Im getting rrrrrrrrrreal mad at my insurance company. Is there anything i can do with any of these problems?? Or am i just destined to get screwed in the arse. someone please give me good news!!!!

Manual trans is usually less in most cars thats why its sometimes called standard and automatic is considered and option. Your title would have been a salvage reconstruction title which dedcuts from the value of the car. The reason for the other items being deduction is probably cause they are using the small little orange NADA book that gives you a price and deducts for everything else and sometimes adds for others
want to find the value yourself?
