Bottom line if you go through your own insurance (your fault or not, other party no insurance or under insured) you'll pay your deductible it's how it works. If you finally got the plate number of the truck that hit you your insurance company or local PD can find out who the car is registered to and you can either try and recover from him or you can file a claim with his insurance company. If you already went through your insurance and your car is fixed your insurance company will subrogate against his insurance company to recover everything they paid out in good faith. If the other insurance company pays up your insurance company will refund your deductible. Point of the story: It sucks but that's how it works. |

Don't always count on getting your deductible back.
Still working on getting my deductible back from my accident. Bitch decided she wanted to make a right turn from my lane while she was over across 5 lanes to my left parked at a bar. She beelined across 2 oncoming (to me) traffic lanes, a left hand turn lane, the lane next to me, and right into the front of my car, practically shattering my entire front end. Deemed her fault, at the scene, through the papers, everything. According to my insurance company it's "In process". It's not like I'm getting free money, but ****, if my deductible isn't refunded, that means they never got THEIR money from HER company when she hit me. (it's on the same paperwork). Whatever.
