I think everyone answered it doug, and that is there is a right to not have illegal search and seizure. Now he could say that there was probable cause, but the record of harassment made could also point towards profiling, discrimination, and subsequently abuse in the form of the unwarranted ticketing (although they are technically warranted).

I'd see a lawyer, and I'd get that officer's badge number.

Well, I've stood up to cops before, and there is a right way and a wrong way to do it.

Stating your rights to the cop is one way to just tick them off. The correct thing to do would be to lock your door and close it behind you. Then, ask for a supervisor to be present when they ask to search. I find that most times when you agree to the search in the presence of the Sgt. it may be a little bit more fair.

Just to point out I also got stopped in this little Police Deal. I probably got pulled over because of my car being modified (thats how I feel anyway) but I was in there with a toyota echo, a chevy trailblazer, a corolla and something else.

I always always always have my license, insruance and registration in a place where I can pull it out like a gun slinger. I had it out before I was even stopped. They asked me where I was going and where I was coming from, ran my plate and said "have a good night."

O and the reason i argued with the cop was because straight off the bat, not even knowing me or who i am accused me of such things as he did shows he has no respect for young adults. He doesnt know who i am or what i do. Yet he labeled me as a drug user and dealer and car theif. **** that. he doesnt respect me, im not going to respect him. treat people how u want to be treated. if he wants to be a smart ass and try to joke around, then il do the same. they had no right to look in my car.

looks like the cop was ****phobic. i mean i would do the same in his position.

As I said before, I think this is more of a joint fault here. Your best bet would be to file a report with the Chief of Police in that Township. I've seen this go a long way. They will then do an investigation and see if the officer was at fault. Here's a similar case on my F-body forum..

DOT approval doesn't mean it's legal. To be legal in the US, you need to meet FMVSS (FEDERAL MOTOR VEHICLE SAFETY STANDARDS AND REGULATIONS). DOT is just a stamp that the manufacturers put on their items. Read into it. Just a FWIW.

The officer was obviously in a bad mood or just aggravated about something else. Throwing in smart comments and calling what he was doing ridiculous was just going to escalate the situation even more (as you found out).

Your best bet would be to follow what Tiny said and politely ask to have a supervisor present when you are asked if they can search your car.

It's not that the way the officer acted was right, but if you just kept your mouth shut, sucked it up, and acted polite you may have drove away with a bruised ego and some pent up anger (but no tickets).

Unfortunately...here in lies the problem with todays laws and legal jargon... There is ALWAYS a loop hole. IN EVERYTHING... contracts, work place agreements ("other duties as assigned") and even in our rights as humans. He'd have to prove he was being profiled. In the end... he'll still end up paying all the fines he got. Until our rights are re-defined and less contamined with legal b.s. we have no choice but to suck it up and nod and say yes sir in these situations if we don't want our wallets to be lightened.

I find in these situations... if you speak with a lisp...and seem very "happy" they don't want to be around you and send you on your way... Got to play to their weakness... seems like ****phobia is one...hahahaha

im not going to report the cop or any of that ****. its a waste of time. all i will get is a letter of apology and the cops looking out for my car.

I bought my car lowered, with exhaust about 2 months ago if that. So i did not modify it.

Also, everything happened so fast. What would you do, if you open ur trunk, and then look back and a cop is in ur front door with a flashlight after they hounded you saying your high and accusing you of doing drugs.

I'd have been nicer to the officer personally. I've run through these vehicle checks before. Been told that my exhaust is loud and probably illegal. I'd say "I'm sorry officer, I purchased it like that." Had outdated inspection and again, being nice, said I'd have it inspected that weekend (and did) and they usually are okay with it. You just have to be nice, even if they aren't. As you found it, if you give any hint of an attitude, even when they are treating you like absolute crap, your wallet will weight a lot less.

It's been stated before, but always request the presence of the Duty Sargent or Supervisor on duty if they insist on searching your vehicle. If you really want to be mean/nice at the same time.. say that you request the presence of the Duty Sargent/Supervisor. Take your keys out of the ignition, hand them to the officer or drop them on the ground outside your vehicle, and roll up your window 'til it's cracked. Put your hands on the steering wheel. If it's dark out, turn on your interior light. Wait patiently.

(i open my trunk to find a bottle of window cleaner opened and soaked the folder plus my jacket.

(i open up a folder full of stuff and start searching.

Officer: Why do you have an extra license plate in there.
Me: Its from my old car, i left it in there from the tags place.
Officer: Are you stealing cars, and making drug runs with this license plate?
Me: what?
Officer: I SAID! ARE you stealing cars, and making drug runs with this license plate!? (angry voice, almost yelled it)
Me: i dont understand whats going on right now. This is rediculous.
Officer: Whats rediculous is you left work to get high and we caught you.
Me:no definetly not.

(so i find my papers, hand them to him and a few minutes go past. The officer radio's in my license plate, the plate in my folder, my insurance and my registration. It all comes back clean and good).

Officer: Well i guess i cant write you any tickets now can I?
Me: I really need to get back to work before i get fired.
Officer: Thats not my problem now is it. Where do you work?
Me: (told him where i work)

2 more officers walk over. One proceeds to look in my driverside door (i left it open when i got out to look in the trunk).

Me: Officer you have no right to search my car, do not go threw my stuff. That is a violation of my privacy.

The original officer steps in front of my in my face and screams "YOU DONT TELL MY PARTNER WHAT HE CAN AND CANT DO. DO YOU UNDERSTAND ME? IF HE WANTS TO RIP YOUR INTERIOR APART HE WILL!."

Me: ok my lawyers will love that.
Officer: Ok you want to play it that way. (kicks my muffler 3 times) modified exhaust.... ticket. No seatbelt when you pulled in. Ticket. Car is illegaly lowered. Ticket. No reg. sticker on the plate. ticket.

Me: I have the sticker right here, il put it on.
Officer: too late, its not on their right now. your getting a ticket.
Me: ok can i please have my tickets so i can leave.
Officer: il be right back.


5 minutes later, 4 tickets later... i was allowed to leave.

This was total harrassment. I cant even count how many times he asked or accused me of being high. Accused me of being a drug dealer/runner and a car theif. Accused me of having beer in my trunk and illegally searched my car.

Do i have a case against them? What should i do. I was completly nice and said yes sir, no sir, no attitude up until he screamed in my face and his buddy searched my car.

IMO coming from a person whos father was a philadelphia P/O, and who is also in the the process of being Philly P.D. u deserved everything u got, never ever tell a P/O they dnt have the right to search ur car, the only thing that made me mad was the total disrespect you had for thoes P/O's..............
