They will probably give you the ticket anyway unless you show them your incoming and outgoing text messages and there aren't any recent ones. If you go to court to fight the ticket, you'll need something form your cell company showing your text messages during that day and the times they were sent and received.

The burden of proof is on them. They have to prove I WAS texting. I dont have to prove that I wasnt.
