That's actually off. The cop is just as guilty as the lifeguard as they are typically trained to perform CPR and operate defibrillators and such, on or off duty, that knowledge is still there. HOWEVER, there may be exceptions to the case for an officer...

How many,if any,of the above can be prosecuted and why?
lets see

sue is in the clear, do to the good samaritan, i think

bob should be in the clear, cause he did make the precaution of hiring a life guard for his pool.

now, both mark and joe duties are to protect and save lives, but, if they did stand around and do nothing, it would be a different story. but, if they both acted to help try to save the child's life, they should be in the clear as well.

so, to me, it all depends on if joe and mark actually tried to save the child's life, or did they just sit around and do nothing.

But what if the cop isn't trained in CPR?

Um...for the same reason every cop is trained to use a gun, they are trained for CPR. Why would a community risk putting just one cop out there who might by chance be the only cop around to resuscitate someone and he doesn't know CPR? Ruin the entire image of the police force that protects the community.

I don't know, but I'm pretty sure I've heard/read somewhere that not all cops are trained in CPR.

All I know is CPR is very dangerous if you don't 100% know what you're doing.

The only person liable is the life guard. Everyone else is in the clear.

In that scenario the happy people will be lawyers. Between the lawsuits that will be filed, the one's doing the suing and the others defending will all get paid.

Actually julz was the only one to get it right, the life guard is by contract legally responsible,as is the father due to it being his child. The off duty cop has no legal connection to the child that died so he is in the clear as is sue. Now if the father went to court and said he couldnt swim, hes now not legally responsible. The law is that you can only be held responsible in the case of the father,if you did everything you could without putting yourself at risk as well.

So annoying

http://galvestondailynews.com/story....8b22f0d0576986 .. Apparently the obligation to perform CPR differs with every police department...

So annoying
not to sound funny, but, what if the life guard then said "I can't swim either."

sorry, had too.

My point was LEOs are trained to perform CPR, which you believed otherwise, and I assessed that point.
