Inspection Shop Liable?

Ok, me and my dad argued about this last night just want to see who is right.
If i took my car to get inspected and without my permission the mechanic takes it out for a little "Road Testing" beats the hell out of it and blows the engine, is there any legal action i could take against the shop?
My dad made the arguement that i can't prove anything so i'd have no case. The shop could just say it was making that noise when it came into the shop, so we gave him a quote to fix it. and their little joy ride would disappear and no one would ever know?
