Tint Ticket Question
I was pulled over today for window tint. My question is if during the stop the officer informed me that reason for being pulled over is that window tinting is illegal in the state of Pennsylvania is this ground for having the ticket dismissed as an illegal stop was conducted based on misinformation of the law? Window tinting is in fact not illegal in the state of Pennsylvania according to § 4524(e)(1) of the Vehicle Code.
Also the § 4524(e)(1) of the Vehicle Code. That provision commands: (1) No person shall drive any motor vehicle with any sun screening device or other material which does not permit a person to see or view the inside of the vehicle through the windshield, side wing or side window of the vehicle. My question here is the section does not distinguish that viewing has to be from all windows. It lists "or" and not "and". So if the vehicle can be seen inside from the windshield is it still illegal if vision is blocked from a side window?
