Legal advice can I get my money back?

I'll try to make this as short as possible. I was looking for a place to move out of my parents house with a roommate. My boss at work got word and let me know he needed someone to take over his son's lease for a two bedroom apartment. I look at the place and thought it was decent and made a verbal agreement to move and take the lease over. He tells me I can move in and that week we would be able sign papers. I guess this was stupid on my part but it was my first place.

A month goes by of me asking him every week when we would be signing papers and then he tells me the land lord doesn't know we moved in and when he talked to the landlord about switching over the lease he didn't want two young guys living there and the only way he would allow it is if we paid more rent. So I'm pissed and ask him if he could talk to him again.

So a couple weeks go by and I asked him this past weekend if he talked to the landlord. He says no and I tell him that I never would have moved in if I knew this was going to happen. He flips out and tells me I'm on my own at work and he will never help me out again(not that he has). He tells me go ahead and move out and the he has someone else that can move in. I tell him I can be out by the end of the weekend and he than tells me that I have to give him till the end of January and I can have my deposit back. So I call him Monday morning to let him know thats what I'll do and he tells me I broke the verbal agreement and that I won't get my money back. He also in a roundabout way told me he would kick my ass if I talked to him in person the way I did over the phone. I stayed relatively calm and can say the only word I called him was a liar.

So I haven't talked to him since later in the day Monday when he called and wanted to talk level headed but never called me back. I have a recipt for the deposit and last month of rent. I would like to move out now and start a civil suit for my last months rent and deposit do you think I have a case?

I already quit I told my job it was me or him and they choose him and the HR lady basically bitched out on me and told me shes trying to work with him on his anger issues. Sorry about the paragraphs its been a stressful couple of days for me.

No really, since it was a verbal agreement, you really have nothing to go on. It's your word against his.

Most likely you will not get anything, because (not to be mean) but you were dumb enough to move in without signing papers ahead of time.

You made a verbal agreement, its gonna be hard to get anything in court out of that.

It sucks that this day and age you cant ride on that even with people you trust, everything needs a signed contract.

I wont go into anything where a decent amount of money is even a little at risk unless I have paperwork to back it up, because there are just too many ways that you can get ****ed in the end.

So should I even waste my time going to court all I have is a reciept and my roomates and my word. I could still screw him out of his money by slipping some information to the landlord once I move out.

I would just tell the landlord and thats it. Chances of you winning are small it seems, and you'd probably have to miss work to go to court, which means you'd technically be loosing money as well, not to mention the stress.

Chalk it up to a learning experience.

Oh I quit already and I am planning on going back to school. I still have to talk to him and see if he changed his mind because I think he was just talking **** when he said he had someone to move in and I know he doesn't want to lose his money.

As far as immature people go I've never met someone like this. He's 40 years old and was calling me little boy and telling me he would put me in my place. Some how it seems like I should have been the hotheaded one.

I don't want to if he says I can't have my deposit but again I don't want to be out another $500 just in case I don't win in court. I don't know which one would look better on my part if I do take him to court.

Did you actually pay all of this money upfront with no written agreement? I'm slightly confused here....

So you gave x amount of money to stay for x amount of time. Now you want to move out before x amount of time. Stay for as long as you can to get your moneys worth, and then let the landlord know that his renter is illegally subletting (unless it's in the agreement that he can do so).

Your first post is difficult to understand, but I don't see why you are out $500 if you stay until the end of January?
