Also, his cop threw out the idea that we were racing. But my cop said I'm getting a citation in the mail for wreckless driving and speeding. Is wreckless driving the racing? Because I was only speeding, and my driving was fine..just fast. Recap: Got "clocked" at 60 in 35, but where they clocked us was a 45. And if they did "clock" him on Smithbridge (the 35) they would have only clocked me cause I was behind him and they were behind me. And cop is sending me a ticket in the mail for wreckless driving and speeding. |

If you were changing lanes and doing 20 miles over the posted limit then careless or reckless driving can be charged. Look on your summons and see where the officer wrote the violation location that will tell you if you were in the 45 or 35 mph zone.

I didn't get it yet, my friend got his though. But regardless, they could not have clocked him at 60 on Smithbridge because he was far in front of me and the cops were behind me.
And are you guys allowed to tailgate? Because that's just ridiculous when you can get up my ass DOWNHILL and make me speed up, then pull me over. |

As for the tailgateing if the officer was tailgateing you. When you go to court ask for the police cars onboard camara to be shown to the judge.

Not sure what street it said, but could that be thrown out in court if it says "60 in a 35", but they clocked us in a 45? Or would they just say it's human error and make it into a 45?
But you're saying the police officers are definitely not allowed to tailgate? I get that all the time when cops are behind me. |

You were forced to drive faster to put distance between your car and the one behind you. You might beat the summons in court, maybe. Frankly I find it hard to believe that you didn't know it was a police car but you were there not me. As for the error yes they can fix that in court.

Well I couldn't tell at all because it was night time, and where I live there aren't really street lights on the roads. So really all I can do is look behind me to see what it is. Plus, when I noticed the car behind me we were going through a hilly part of the road so it was in and out of my view, until I noticed and slowed up to 40 and tried to play it off like the huge downslope we were on made me increase my speed.
Also, the police officer that pulled me over was a Birmingham officer, but I called there and they said they have no record of me being pulled over on Saturday night. They also said that all their citations go through the Downingtown court, but my citation will be going through the Glen Mills court (which would be the case if the state trooper had pulled me over and issued the citation himself). But is that allowed for the one officer to pull me over, and then have my citation filled by a state trooper? To me that seems unfair because for one the Birmingham officer did not have anything on me, he didn't even have my speed. And two, I stand a better chance with him because he probably wouldn't care enough to go to court. |
