Options for dealing with a problem...

Ok, so there is this old bastard who works in my office. He has his thing where he thinks he is above everyone and therefore can smoke his cigar in a closed air building. From what i hear he has had blow outs with others regarding this and he continues to do it. I myself have walkd up to him and told him to put it out to which he said "im not smoking it". So, short of walking up to him with a fire extinguisher and getting fired what are my options? Does anyone know if i can call the cops or the fire dept to fine this ****er? His son is the head guy here and he has said something but really, does a son ever have control of his dad, so going to him is pointless.

I am so close to fliping out, this is the most ignorant thing i have ever had to deal with. how can he think its even remotley close to ok to subject 50 some peole to his smoke just because he feels like taking a few puffs. Rant off.....

If you're in NY, then it's illegal.

I would talk to the son politely and inform him that you would rather not have to take it any further than this but that he needs to stop.

He has zero legs to stand on.

If it really bothers you, speak to your supervisor. If you have a human resources department, speak to them as well. document the time and place for both meetings, and what was discussed. If nothing is done, I dont know what legal body is directed to enforce the smoking ban, but I am sure a call to your local PD would get you the info you need.

Dont ruffle feathers, because what will happen if you dont give your company a clearly DOCUMENTED chance at telling this guy to stop this behavior and following through on it is that you will get the COMPANY in trouble. Sure the guy will get in trouble as well - but you will take flack as well. Keep it internal, document what you have done. If nothing changes, contact the authorities.

the documentation is to cover your azz if they fire you for getting the company fined for a code violation.

In the corporate world, politics is EVERYTHING so DO NOT stoop to his level and do office guerilla tactics like supergluing the guys cigar to his lips. Be professional and do it the right way.

EDIT to add: I'm from NY. Smoking in any building is illegal. No company would be dumb enough to allow this behavior.

Nexttime he lights one up, tell him to put it out. If he resists, quickly grab ahold on his nose with one hand and shove the cigar down his throat and clamp his mouth closed with the other. After around 20 seconds he'll be choking real good and turning several different colors. At that point, let go and say ' see dude, smoking IS hazardous to your health'

I did that to one of my helpers in a customer's back yard after he argued that smoking doesn't hurt anything. He NEVER lit one up near me again..ever.

This is a non-smoking building but im sure if it is illegal per-say in pennsylvania. I think at this point its more of a bulding decision along with being against the fire code, but nothing that specifially states in law that smoking in a building is illegal.

x2! This is the best advice.

The only way this guy can get away with it is if he is related to the owner. other than that no individual employees habits are bigger than the company as a whole. he will be told to stop or they will show him the door.

yeah and sonny boy is the head guy and he just let is slip past. he says things to his dad and his dad will ay ok, i wont smoke anymore and is lighting up as he walks out the door. Its a nice little charade for his benefit and not ours. I am sitting here right now smelling it.

If its in PA like it seems then hey there really is no law against it in PA yet. Also if his sons the head and doesn't care sorry you really can't tell him to stop. I think you can maybe start a petition though that might help iono hasn't been brought up but you know start one get all those to sign it bring it to the son if nothings done let the office pranks begin. But thats only as a last resort
