Any lawyers in the house? I need help on a smoking issue!

I am wondering what my options are in regards to a situation at work. There are a few people that smoke while indoors and the smoke drifts into my work space. I have found SB 246 that was recently passed by the PA senate which expressly prohibits smoking but I doubt the $100 fine will stop them from smoking, if I could get someone here to even catch them in the act. I have repeatedly asked all levels of management to address this issue as well as approaching the smokers myself while they were in the act, all of this proved futile. I want to know my options, can I sue, can I leave work and not be subject to firing for doign so since they are violating my rights and breaking a law?

dunno, take the cigs right out of their mouth and stomp on it. Print out a copy of the law and leave it on their desks, send a company wide e-mail with a link or copy of the law, etc. Make sure everyone knows its illegal.

Where exactly are they smoking?

just wanted to add that I would go out of my way to make their lives hell for smoking near me. I hate cigarette smoke and if its coming into my workspace there will be hell to pay

anyway if they are smoking in a smoking area you cant do nothing about it unfortunately. your next option would get that spot banned for smoking . Unless it says they cant smoke in the building anywhere like posted then unfortunately I dont think you can do anything about it

however, it is illegal to smoke inside office buildings...

probably due to the circulation of air and it being a health hazard to everyone. There are no allowed smoking areas inside offices.

I am on the 9th floor, they smoke in their offices generally but will walk around with them lit once and a while. The building has made this a non-smoking building, they have a spot outside and they have repeatedly warned and fined them previouly when they would hang out the window and drop their butts on the roof below.

I have sent an email to my direct boss to document my issue with them smoking. I have also repeatedly walked in on meetings and demanded they be put out. I have placed images of smokey the bear pointing at them in direct line of sight accompanied by the law so they can't miss the fact that it is illegal. I have avoided doing anything that could be preceived as threatening or dangerous as i don't want to give them any reason to fire me.

I know, and thats my problem, I don't know what else to do. I am already looking for a new place of employment but while I look I can't afford to just quit but I also don't want to breathe in this crap, it makes me want to vomit.

I am wondering if a law suit would be possible but I don't know what kind of evidence is needed to bring such a case. I have tried to take pictures but they never come out right, whenever he sees me he will quick hide it or try and put it out or shut the door.

you need a little spy camera. and if it makes you want to vomit...vomit, go right up to the guy, breath all that smoke right in...and let it all out right on his desk. He'll stop smoking, promise.

Couldn't IMAGINE why...

but most of my offices that I've worked in, they were never allowed to smoke inside.

It's seriously ridiculous.

Get everyone that doesn;t smoke together and leave the office every time that someone lights up. The absence of a large majority of the office will get their attention.

I like the gas mask idea too.

Matt, if I were you I would actually contact a lawyer to discuss your options. As far as I know what they are doing is illegal, and even though I smoke, I find it disgusting smoking indoors. If it's posted no smoking, you've complained multiple times, and they've been fined for it but continue to do it, then I think you have actual grounds for a lawsuit.

The gas mask is a good idea, I actually wore one, one day. Obviously the message didn't get through. Lower level management has told me I could leave on certain days, when it got really bad, I am talking like a smoke cloud you see in bars. But if I did, my work wouldn't get done, the programs would be late and they could fire me for that, so I am kind of stuck.

CONTACT OSHA! NOW! You don't deserve to work in those conditions and the law specificially states this. Your place of work has a Labor Law poster somewhere in it, if it doesn't then the whole place is really in trouble.

You most certainly can sue and its illegal to be discriminated against for doing so.
