ouch, that reeeaaally sucks. I would think that if the SAFC is covered under warranty, they will at least repair or replace the deffective unit. as for them paying for a new tune, that will probaby be up to them and the level of customer service they operate with.

Oh that sucks!!! You don't have your corrections written down somewhere? Remember to write down ALL of your info from the AFC somewhere just in case it happens again. I've heard of this happening before and it sucks but I don't know if Apex'i is going to do anything about it.
Is it supposed to save the information in case the battery dies or something along those lines?

I would call customer service and just keep asking for the persons manager till you cant get any higher and talk to the person calmly about it. Most companies will try and avoid legal situations cause it will end up costing them much more money.

Honestly, I understand that you are very pissed off, but I don't think you are going to get anywhere. I'm not trying to be a dick here, but I highly doubt you have any sort of case.
Think about this: If you're working on a presentation for a company on your computer and you don't back up the presentation anywhere and suddenly the computer crashes and you lose it all. Do you think Microsoft is going to pay for it? Sure if there IS in fact a problem with the computer, you may get a replacement if its still under warranty. Any work or information that you lost however, I'm going to say you're SOL. Another reason A'pexi probably won't do anything is because of the fact that YOUR wiring could be at fault. It really doesn't matter how many people have looked at it and assured you its good, unless A'pexi has certified technicians that do installs, and you paid the premium to have them install on your car, they can blame you and you can blame them. No way to be positive either way. Again, I really understand how pissed you are and I would be too. My only advice is to learn from your mistakes and write down the settings before leaving the dyno next time.

The dyno tech is a Apex'i Safc specialist. He was trained to tune them and has some kind of cert. or something.

Being as you didn't have Apexi do everything Directly.
They will probably laugh at you and shut the door on your face. Instead of getting a giant headache...get a new Safc tune it again and drive it like you stole it.

I agree that they probably wont give you anything. BUT in the case of an safc, they are easy to tune if you know where to set it. SO, next time, when u get it tuned, definately write down your settings, so if anything ever happens again, you can re-set it.
I had the old version of the SAFC on my old GSX, i didnt buy it new so it was tuned for a GTS, when i adjusted it, it was fine until i shut off my car, but then it reset to the GTS settings. There is something you have to change to make it save to your new tune. I'm not saying the guy didnt know what he was doing, but i would definately make sure its not user error before you call. Because, if you do want a replacment, ur gonna have to pay to ship it back so they can check it and make sure its a faulty product, if its not a faulty product then you also have to pay to ship it back to you. So, i'd definately knock out all the simple problems with it as to incur more charges.

$600 is hardly enough to sue anyone over. If you did try to sue them, it would go to small claims court and the court costs may even more than the settlement IF you got the ruling.
Your best bet is to demand a retune from the guy that did it on the dyno and if he says no, talk to their managers/company owners. If they say no threaten to go to the Better Business Bureau. Thats seriously all you can do. I know $600 is a lot of money to you ( it is to me too!!) but in the real world where companies throw around 100s of thousands...its a drop in the pan. People get gyped out of small amounts like that all the time, but most people dont care cause it isnt that much. (think about the McDonalds guy who short changes you $1.50)... I am also wondering about the TT comment.
Chances are that Apex'i already has their asses covered in the form of some sort of disclaimer. It acts much like an end user license agreement (EULA) for windows or any other piece of software. If you ever read those things, they basically say everything short of saying that the software will not work! Apex'i is a big company, so I am sure they have had pelntly of lawyers on their side from day one to watch their backs. However, it is still worth a try to see how far you can get (without being a dick).

Yeah, Sue a company because you abused your engine after getting some half-assed Super AFC tune and your engine blew up. God Damn it Apex-i, those bastards, make them pay.
Take a deep breath and realize THE TRUTH about what happened to your engine. Now look in the mirror and get prepared about what you are going to say to the person who caused all this damage. Take responsibility for something for once. We all make mistakes.
