Passing

Hey Sarge. I figured I'd try to break an urban legend I've heard time and time again.

When driving down a road (say a 2 lane road with double yellow lines, hard shoulder, etc.) you come upon a vehicle, in your lane, traveling 15 MPH or more under the posted speed limit (30 in a 45 for example). He is continuing at this pace for some time. Is it legal to pass the vehicle at that point?

In most cases I hit my hazards so I'm not rear-ended, but have thought about passing before.
