About trading in a hit car...

my car was hit by a high under age drunk driver. as far as i know, hes getting a couple slaps on the wrist and a fine. thats it.

me on the other hand. i feel like im getting royally F'd.

say i wanted to trade in my cobalt. its almost a year old now, not even 10k miles. except its been hit by a drunk driver, but fixed by the dealer.

even if it looked perfect and brand new, i wouldnt be able to get full value on it would i?

so how come i get ****ed in this situation. i wasn't the drunk driver or anything. shouldn't i be compensated for the value of my car somehow?

In my opinion you should, he depreciated the value of your car drastically. I remember the pics, there was a good bit of damage.

get a lawyer, youre going to need it fighting the big dogs for money

roccobladr 08-03-2007 09:55 AM

id hate to make a big deal in court or anything. im not looking to take advantage of it, i just think i should be awarded some kind of money for the depreciation of the vehicle.

CHAOS 08-03-2007 09:59 AM

i agree with you, but i highly doubt youll get anything if you havent gotten it already from insurance.

i know your car was parked when it was hit, the same thing happend to my g/fs car 3 years ago.

she got a brand new toyota camry and had it for 3 days when someone plowed into it at 3am while it was parked up her street. It was a hit and run sorta thing, so she had the car fixed. We recently went to trade it in and the dealer was giving us all this bull**** about the car being in an accident and such. I didnt know that even though the car was parked and took a hit and run it still goes on the carfax as an accident, and then most dealers will have to wholesale your car.

My advice would be to either keep it as long as you can now or get rid of it as fast as you can, becasue of the depreciation thing, your more than likely not going to get a good trade in deal now becase of the damage caused by some iddoit drunk driver.

if im not mistaken, if your in an accident where your not at fault im pretty sue you can sue for depreciation on your car. someone told me about it when i had my accident, but technically i was at fault cuz i got ran off the road and the other guy took off........so i know how ya feel. if i ever see that explorer again..........

RayArroyo 08-03-2007 10:54 AM

lets just say i traded my cobalt ss supercharged in last year with 6k miles on it hit on the side and fixed by my dealer and took a 4k dollar hit on the trade

got 13k dollars for it

insurance companies are a joke. you pay for their help for them to only **** you over.

i'd look into it..cause you should get something out of it..especially for the fact that he was under age and drunk! not to mention your car was freakin' parked!

Just like Chaos said your going to have to fight it to be awarded money. simple.

turbo4g63 08-03-2007 01:52 PM

you are pretty much screwed...taking insurance companies to court would be like me getting into a fist fight with a grizzly bear

If you can find out how much your going to lose because of the repair, you can try to file a civil suit against the kid that did it and reclaim your money directly from him
