Flipping through the latest issue of Import Tuner and what do I see...
 
So on my lunch break today I was killing time and went to flip through the latest issue of Import Tuner (Oct. 08). I was looking for the article about the Supra on the cover, and in my search I landed on the opening page of the article they wrote on Formula D... with my photo as the main art! I had sent them some photos to look at but hadn't heard back. Obviously I have attempted to contact them again to talk about the 15+ photos of mine that they used throughout the article, so we'll see where that goes. They did give me the photo credit though on the first page, so thats a good start.
Anyway, it was definitely a surprise and I'm happy, but not at the same time since the communication on their end is seriously lacking for me to find out this way.
Scanned the pages though to check out... look closely and you may seem some local TST sights making it big in the pages of Import Tuner :wink: Name em if you find em!

I'm pretty sure every photo on these 2 pages is mine...

Awesome that they published your pics, they should have at least let ya know. I'm sure they have some sort of disclaimer about material sent to them being theirs to do whatever with, but very cool nonetheless.

Ha, no thats not how it works... I dont want to really get into all of that on here right now though... just wanted to post the photos since I though some people would think it was cool.

very cool dude. i always wanted to send pics into them, but never did. not that im a good photog or anything but i always had nice pics of different events I had been too.

You do take some really sick photos. Whenever I get my beast lowered and finally get the FMIC on (short a jpipe) I need you to take some pics!

well, i was gonna say copywright infringment , but since you sent them the pics, not sure you would win that lawsuit. lol. but some photog in philly did filed a suit for similar things and it looks good for him.


btw- calling them will get you nowhere fast. Have a lawyer write a letter. that always gets a resonse. :) unless you explicitly told them they could use the photos.... how exactly did you word your letter when u sent in the pics??

I'm not getting ahead of myself here... I expect that as part of a very large media company they are familiar enough with usage rights, and that this one just slipped through the cracks.

congrats for your pics submitted being used by a mag of that stature(always respected the photography in that mag). let us know how if any compensation works for that.

why the hell would you be upset? it's not like they're personal photos or anything, they're fukcing cars.

because the photos were used without my consent, technically. we were discussing the use, i didnt grant them permission.
if its a hobby then sure you just want to get published, but when its work its something you need to be paid for. useage rights are actually quite serious and very important in the field.
no worries though, i'm talking to them now so its all good. i'm confident that we will work out something fair for the use of my photos.

artwork is copyrighted the moment it is created :). however the law states you can't pursue legal action over copyright without first registering it.

Thats cool, but if you actually did get a hold of them to discuss being paid for your photos, they probaly would have just used someone else's that they didn't have to pay for....

If a magazine (or any business) could get away without paying their employees I'm sure they would, however no decent photographer (or employee) would work for free, its just not how it works. If they make money, I make money... thats how I look at it (meaning that at times personal use and charitable organizations are exceptions to getting paid for me)

I agree, i know how it works. But they probably feel giving you the credit and the exposure u will receive, and also being able to add it to your portfolio is payment enough. Not saying i agree with it, but it happens every day im sure....

I see what you're saying and I'm sure there are desperate kids out there who would assume the position for a magazine like Import Tuner, but for the most part thats not really how it works. A noob who works for $0 is probably going to produce $0 worth of material. Anyone with experience and talent should understand what they're worth and not get taken advantage of.
Its like me telling you you can build a car for me with all parts at cost and 0 labor and it will be great experience for you and that I'll be a good reference for you in the future. You'd never do it and I'd never expect it... same thing in the media industry. Writing, photography, editing, layout, printing, etc... they are all essential jobs that go into getting that magazine on the stands every month and keep it profitable.
