There is tons of studies that say there is no difference between hands free and holding the phone. The problem is talking and listening, being engaged in conversation. Its not physically holding the phone.

They will probably give you the ticket anyway unless you show them your incoming and outgoing text messages and there aren't any recent ones. If you go to court to fight the ticket, you'll need something form your cell company showing your text messages during that day and the times they were sent and received.
