View Full Version : do you fight no point tickets?

i got a "careless driving" ticket this morning for accelerating to fast i guess. this is the second "no point" ticket i've received, i don't really want to pay it so i thought about fighting it, but i don't know if it's even worth it.. what do you guys do ? i'm pretty annoyed by it because i didn't know there was a law that said you can't speed up to the speed limit quickly, the cop seemed nice and it was in springfield, i thought for sure i would just get a warning since i run with springfield ambulance, guess he was just in a bad mood.

and yeah i know this should go in the ask the law forum but quite frankly that place is a ghost town and i actually want to get responces

we have a new officer, and he answers very quickly

hold on since when did careless driving become a no point ticket? last time i checked it was 2 or 3 points. Springfeild nailed me for careless also back in november. im fighting it, simply because i downshifted to slow down (hints the dead stopped tafic in front of me) and the cop only heard my car so he turned arround and pulled me over. he asked how fast i was going, i replyed with excuse me? how can i help you officer?. tall skinny old going bald cop. Needless to say im pretty sure i have the upper hand beings i have witnesses in the car and a good laywer

statue 3111 sub sec a fine $25 and like $75 in taxes and crap comes to 107

thats the same total as what mine came out to, so i would say check with the court before you assume that his word is good. Cops like to do this so u dont think about actually going to court.

As far as I know and in my own personal experience there are two types of careless driving tickets one is 2 pts. and the other is no points.

I once recieved a 2 pt. careless driving ticket and then in court it was reduced to a 0 pt. careless driving ticket.

I would call the Courthouse or Police station and ask someone if the ticket is 0 or 2 pts.

From what I remember there is like a one number difference between the two different violation numbers.

EDIT: If it turns out that there is no points I wouldn't even bother fighting it.

The ticket is not for careless driving, it's for "failure to obey traffic-control devices". The cop gave you a break, it's no points. Don't rely on what he writes as a description, always go by the statute listed:

§ 3111. Obedience to traffic-control devices.
(a) General rule.--Unless otherwise directed by a uniformed police officer or any appropriately attired person authorized to direct, control or regulate traffic, the driver of any vehicle shall obey the instructions of any applicable official traffic-control device placed or held in accordance with the provisions of this title, subject to the privileges granted the driver of an emergency vehicle in this title.

careless driving is 2 points in PA. Trust me I should know.... I got one a few years back when the cop cut me a break instead of reckless

Actually, careless driving is 3 points. But, fortunately, he didn't get a ticket for careless driving.

Basically it means you ran a stop sign or in some eqivalent way broke a rule but didn't actually hurt anyone. In your case it was your "unsafe" acceleration. I got a two point ticket knocked down to that.

If it were me, I'd show up to court. Best case scenario, no points but pay fine, worst case = you get to pay fine and realize later that its 2 pts.

it's no points, but it is listed as careless driving ( going by what they said when i just called )

It's 3 points for Careless Driving. I had 3 of them. Got 2 dropped and still have one pending. That is one of the "bull**** tickets" next to Exhibition of Speed, which is one of the most ridiculous tickets I've ever seen.

You got lucky though. I only ever got one of those no point VC 3111 tickets for 42 in a 25. was lucky.

Yup ive gotten that before. And i wouldnt even bother how much less are you gonna pay....and for the money you may lose not going to work it prolly wouldnt be worth it since like they said it doesnt affect insurance.

after having 20+ tickets in my lifetime so far and never losing my liscence (knocks on wood)- well a GOOD lawyer is a family friend and my pops was a philly cop... BUT-

points tickets= fight them till the end. go to court without a lawyer and talk to the cop to see if you can work something out before trial begins. if not then take it to trial and try to convince the judge... probably isn't gonna happen and you'll lose so appeal it and go to the next higher court with a lawyer. costs like 30$ to appeal it, + lawyer fees BUT*** your insurance WILL go up once you have points so you are saving $ in the long run paying the lawyer in the short run.

no points tickets= pay them you cheap bastard! the cop probably cut you a break anyway so help him out since he helped you out!

carless driving is definitally points...your best bet would be to fight it so you wouldnt get points. You can do a few different things but it will cost more money in fines to get rid of the points. You should be able to go to your state dmv site and it will show how many points your ticket is. You dont need a lawyer that be a waste of money he will give you the same advice that i will which is you can take unsafe driving which is no points and a larger fine or if you have a phone bill and you were on the phone within an hour of the time stated on the ticket you can pleed guilty to cell phone infraction. I just went to court last week for a 3111a, I'm sick of getting a "break" by getting a lesser ticket, I've never in my life ever got a "warning". If you want to give me a break, give me a warning, otherwise write me for whatever it is you think I did and I'll see you in court. I went well prepared and case was dismissed. $115 back in my pocket, and I'm salary so it didn't affect me missing time at work, and by chance I work like 10 minute from the court house that this citation goes with from the state trooper. BTW I've never had points on my license, fight everything.

the only ticket I havent fought in my driving career (i've had plenty.... haha) was a failure to use my turn signal...

I fight everything else... its worth a shot.

what exactly did you say/do in court to get it thrown out?
i got one of these a few weeks ago. since it was no points, i just paid it.

I had a 27 mph over ticket which was 5 points dropped to a 3111a this year. That was kinda sweet, definitely better than I was even aiming for.

ive had a couple careless drivings and i think only 1 reckless driving. all of them had points :lol:

basically anything you do can get you in trouble.


yesterday i was cruising down the a/c xpressway 65mph in a 65, i saw a cop so i slowed down a bit. so basically because i had numbers written on my car from the drag strip, the cop pulled me over. he tried to find something to pop me for but 'let me off with a warning' for crossing the white line or some bull**** like that. bottom line is your not safe out there, just try to blend in with the pack, or else...
