Motorcycle with no insurance

STORY GOES: my friend road my bike lost control slide across the street, went on to the sideway, ran into someones fence and hurt a pedestrains leg. he has no motorcycle license, but the story is my bike did not have insurance aswell. I did not tell him to ride it, i kept telling him to get off, the police took then regis. and got some info off of it, but did not ask me for insurance. No ticket issued.
MY QUESTION IS: Am i (my bike) at any fault? he (the dumb rider) said i can get into trouble aswell, but i did not tell him to get on my bike. im even thinking about pressing charges on him, for stealing, i couldnt grab him off my bike then that would of been asault. NEED UR HELP!

2. Why were the keys with the bike?
3. Did the police do and accident report?

You and the rider are both at fault and you will be liable for the injuries and damages. Your failure to maintain insurance and control of you motorcycle (ie;removing the keys) puts you in a bad place legally. You can try suing your friend to recoup any damages you have to pay. Charging him with theft after the fact is most likly not going to much good.

but if i press charges against him, wouldnt that protect me? he did take it and not having a motorcycle license.

NO... You would have to prove in court that he committed a theft since he would be the accused the burden of proof would be on you. I can tell you that a judge would have to be pretty dumb not to see through that one. But lets just say you do charge your "friend" and he is found guilty. You will still be responable for not have insurance on the bike.
