View Full Version : got a speeding ticket today, cop says i went faster than i was

ok so i was speeding, but at the same time following behind another car.
not really paying attention, and got pulled over.


cop said "what's the rush?" and claimed i went 70+ mph in a 35mph zone.
i told him i was most likely speeding but definatly not 70+mph.

he runs my paperwork comes back and gives me no points.

here are the citation details

well there is an option for speeding, we he did NOT check off and fill out.

instead he filled out the "other" section and wrote "defendant failed to obey the posted speed limit of 35 mph by traveling at 65 mph."

i asked him how fast i was going when i received the ticket and then he said 65mph.

why he changed his own story on me makes me wonder if he even clocked me.

However I did not receive posts but I will be taking this to court.
thoughts?

the worst part was i had to hear a 30 min spiel from my girlfriend afterwards about how she could help argue the case and i should be thankful because in 2.5 years i will know several lawyers :sleep:

i was told a while back to ask politely if you can see the speed posted on the radar gun (or the time on the stopwatch for vascar, or whatever), and quietly make observations on what model it is, how it is mounted, and anything else you can notice about it because its all valuable info in court.

edit: woops sorry i didnt realize this was ask the law or else i would have waited for an answer from the guys in here. i'll leave it up but sorry...

well troll, if a cop ever allowed that I would be surprised. We do not ever, in NJ, let someone get out of their car to see the radar unit. There is no reason to. Also the speed does not stay on the radar unit. When you drive by it pops up and then flashes off. Also it will change as ur speed changes. For instance, if you were traveling 50mph, and then started slowing down when u saw me, the radar would flash 50, then 49, then 48 ect. It is constantly changing. Anyway, in short, a cop never has to show a person their radar unit.

And to the thread starter, i would suggest going to court, and speak with the prosecuter. Tell him your case and see what he can do. If you dont like his ideas, you can always take the ticket to trial, and let the judge decide. Hope this helps, but i reccomend going to court.

understandbly going to court and fighting it is the best option, but $109 bucks, it may not be worth it to waste a day waiting for myhearing

tru, but this ticket that you recieved may carry insurance points, and if u go to court and get it reduced, they may give u a ticket with less points on it. So it will be cheaper in the long run.

just to respond once more... i have asked to see the speed on the radar gun 2x and they have allowed me to both times... this was in CO and at least one time the cop said he absolutely did not have to show me but that he would. i am always incredibly polite and kind of do the 'speak when spoken to' thing when i get pulled over.
i honestly didnt believe i was going as fast as he tagged me, but what do ya know... apparently that damn WRX feels pretty comfortable on mountain passes at 69 mph...

yea some cops i guess will, but I know i would never. For me, its a safety thing. I dont let people out of the car unless i need them out. I am able to control someone alot better while they are in their car then out.
