I know someone stupid who just got pulled over for doing 130+ in a 65 in Maryland...
Is that instant arrest here?

Most traffic offenses fall into a "traffic infraction" category, where the punishment is simply a fine. I'm pretty sure speeding on its own falls into this category. However, if you are charged with reckless driving in conjunction with speeding, some states consider it criminal misdemeanor charges (like NJ) and you "can" be arrested on the spot. In general, if you are given the option of appearing in court for a pre-payable fine ticket, you cannot serve jail time. If you receive a "you must appear in court" ticket, then jail time is an option.

And just to make it clear, I too would like to verify how it is handled in PA. As for my knowledge, though the badge I carry in NJ is not a law enforcement one, I have dealt with plenty of criminal cases from several angles at work as a bondsman and arresting fugitives on bench warrants. I've worked closely with local police a lot, and the head of our fugitive recovery is a retired long time member of the sheriff's office in Trenton. So, I in no way know all of the laws in NJ, but odds are if it's something I don't know, I can find out.
Anyway, on with the legal discussion.

yes he is.. In philly you wont get arrested for a traffic violation.. dont know about other departments...

I was pulled over a while back in bucks county...the officer told me he pulled me over because i had an exhaust and it was "illegal to put anything aftermarket on your car that will make it louder." he did not give me a ticket so that is why i want to know if its true. PLEASE can i only have a response by 04crownvic, i already posted this before and got enough opinions. THANKS :)

it is technically true
i got pulled over for that, and asked a friend who was a cop. Any exhaust system, that is NOT OEM is illegal
but then again fishing while riding a horse is illegal too

yes that is true, they can site for noise violations and emission violations for any kind of after market exhaust..

It was more the fact that they're still laws. I really am just curious.
Most, if not all, auto sales places are closed on sundays (probably a coincidence)...it was really just a thing of curiosity, not meant as a joke or an insult.

I have a question.
I know that really dark tint is illegal on the driver and passenger windows BUT, is it illegal to have dark tint on you'r rear window??

hey guys because there has been an overwhelming amoutn of people responding to questions already, i'm no longer allowing anyone to post in existing threads. the format of this section should be: user posts question, officer answers. thats it, no back and forth from users who probably are just guessing and confusing things further. if you dont have a badge on your shirt, then you are not supposed to be answering any questions here.
i'd like to have the format be: user posts question, officer answers, user posts followup for better understanding, officer answers again, etc. but that wont be possible with the way it is right now. i'm looking into our options but there is way too much clutter and confusion already in here when the whole point was to get clear cut easily understood answers on the law.
