Its not legal to pass on the right, the law is you drive right pass left. Also, the J-walker is wrong. When I took a course for my CDL a state trooper came in to answer questions. He said if someone is J-walking and you hit them, it's their fault, if they are in a crosswalk its your fault. You shouldn't try to hit them, but (when they are not in a crosswalk) you don't actually have to stop for them.
I only got an 80, but I was interpreting some of the questions different from what they were.

I was looking for the hit the pedestrian answer but they forgot it?
80%, you have to remember, that test is generalized for all the states.
I know you can't pass right here, but everyone does anyways because people love chilling in the left lane. And I know in Pitt, pedestrians ALWAYS have the right of way, and it's annoying as hell...

**** question 8. In NY it is illegal to pass on the right on the highway. I don't care if it's a generalized test. You shouldn't ask questions that different states have different answers for. I got an 80.

14. When you are merging onto the freeway, you should be driving:
A. At or near the same speed as the traffic on the freeway
B. 5 to 10 miles per hour slower than the traffic on the freeway
C. The posted speed limit for traffic on the freeway
Apparantly the correct answer is A. So... when getting onto I95 I have to be going 95mph at the end of the offramp? ****, good thing my cars aren't slow.

I got a 90% but one of the questions is kind of awkward. The one about the distance before a turn when you should start signaling and the answer was 100 feet. However, the distance is lower depending on speed according to the PA book
