Parked Car Accident

My daughter was parked in a parking space at a mall in PA. As she was getting out, an SUV pulled in next to her and my daughter hit her door. It was wedged into the front quarter panel and put a big dent in it. The lady backed up to dislodge it. My daughter said she flew into the spot. The lady says its my daughters fault but I'm wandering whose at fault.

Is there a police report?

No, The lady did contact the police after and they said they probably wouldn't have filed one anyway. There is no damage to our car only hers about $1500.

1st your daughter should have called the police the driver pulling into the space has to be sure that it clear and safe before pulling into the parking spot as for her "flying in" a police officer could have determined if that was in fact the case. Without the police report and based on what you have claimed. I would say the the SUV is a fault and I would have my insurance fight it out with the other driver.
