This question is relative to a previous question posted by another member. Only in more detail. I am speaking in third party.
You are a undercover officer. You are witnessing streetraces and you are told to take down tag #'s of the vehicles involved. Tags are writin down and summonses are issued to the registered owners of those vehicles. But the issue is that the registered owner that is summonsed was not the actual driver of the vehicle. The question is, is the owner of the vehicle still responsible for the citation even though they werent the driver that evening? And if there is no physical evidence to prove it that they were, (I.E eyewitness, video, photos ect...) whos responsible for providing the proof of who was. Guilty until proven innocent, or innocent until proven guilty.

As the owner of the vehicle you are responsible for it. If you loan it to someone and they commit a crime or a motor vehicle violation it is assumed that the owner is ether driving the car or knows who is driving the car. So it would be the owners responsibility to report to the police who was operating the car if they were not. Then the summons would then be issued to the third party driver.
Thats how come the summons were issued to the owners...innocent till proven guilty still applies since they have not had their day in court. If you pay the summons you admit guilt!

PS: Stay away from the street racing your only going to get in trouble. Go watch the races at E town they need your support.

Thank you for taking the time out to answer my question. My question was actually for a friend of mine who was in the wrong place at the wrong time.
